The website and materials on Aerosend.io are provided on an “as is” basis. To the fullest extent permitted by law, Aerosend Ventures Private Limited disclaims all warranties, expressed or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Aerosend or its suppliers be liable for any consequential, indirect, or incidental losses arising out of the use or inability to use the website or related services.
This includes (but is not limited to): loss of profit, revenue, data, goodwill, opportunity, or business continuity.

Accuracy of Materials

The materials appearing on our website are for general information purposes only. Aerosend makes no representations or warranties about their accuracy, reliability, or suitability for any particular purpose.

Aerosend has not reviewed all external sites linked from its website and is not responsible for their content. The inclusion of any link does not imply endorsement or control. Use of external sites is at your own risk.

Right to Terminate

We may suspend or terminate your access to our website and services immediately upon written notice for any breach of these Terms.

Severance

If any provision of these Terms is found to be invalid or unenforceable, that part will be severed, and the remaining provisions will continue to apply in full force.

Domain Ownership (BYOD)

Aerosend’s standard service is bring-your-own-domain (BYOD). Clients purchase their own domains from any registrar (GoDaddy, Namecheap, Porkbun, etc.) and connect them to Aerosend’s infrastructure.

Domain ownership remains entirely with the client at all times. In limited cases, Aerosend may purchase and manage domains on behalf of clients as a special arrangement; in those cases, ownership stays with Aerosend for operational continuity, and the client may request domain transfer at any time at no additional cost.

Email Recipient Policy

Our services are strictly intended for B2B communication. Clients must not send emails to personal email addresses (e.g., Gmail, Yahoo, Hotmail).
Violation of this policy may result in service suspension or termination.

Unsubscribe Policy

Each client is required to:

Include a visible and functional unsubscribe link in every outbound email.
Maintain accurate unsubscribe records and ensure compliance with opt-out requests.

Failure to comply may lead to immediate suspension or termination of services. Aerosend prioritizes user consent and data privacy.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India, and any disputes shall fall under the exclusive jurisdiction of the courts of New Delhi, India.

Refusal of Service and Refund Policy

1. General Non-Refund Policy

Aerosend operates under a no-refund policy, except in specific cases where service limitations arise from factors within our control.

Refunds are only eligible within the first 14 days of usage.
Refunds exclude any domain registration costs, which remain non-refundable once purchased.

2. Exceptions to the Non-Refund Policy

Refunds may be issued only if:

The customer experiences service quality issues directly caused by Aerosend.
Refunds exclude misuse, third-party disruptions, or customer-side issues.

3. Right to Refuse Service

Aerosend reserves the right to refuse service to any customer at its sole discretion.
If service is refused, refunds (if any) will deduct operational and domain-related costs.

Domain costs are non-refundable but ownership can be transferred upon request.

Refund and Domain Replacement Policy

1. Refund Calculation

Refunds need to be requested within 14 days of the first order.

2. Refunds are processed within 3 business days after dispute resolution.

3. Refund Dispute Process

Mailboxes must remain active during the 3-day dispute window.
If mailboxes are deleted before resolution, refund eligibility is voided.

4. Right to Refuse Refund

Refunds will not be provided for:

- Spam or bulk violations.
- Exceeding 40 emails/day/mailbox.
- Warmup duration under 14 days.
- Omitting unsubscribe text.
- Sending to free email domains.

Subscription Renewal Policy

Subscriptions renew automatically unless canceled prior to renewal via official communication channels.
Cancellation must be submitted before the renewal date.

Domain Renewal

For standard BYOD setups, clients are responsible for renewing their own domains directly with their registrar. Aerosend does not handle domain renewal for BYOD setups. Aerosend handles all DNS configuration (SPF, DKIM, DMARC) so your inboxes work correctly, but the domain itself stays with you.

For special-arrangement domains purchased by Aerosend on a client’s behalf, renewal is handled only for accounts with active subscriptions:

Domains up to $15 (₹1,250) are renewed automatically.
If renewal costs exceed this amount, the client must cover the difference or opt for a free domain replacement.
Aerosend will not renew the domain if:
- The client fails to pay the extra renewal cost.
- The client cancels the plan before the domain’s expiration.

If the subscription ends before the renewal date, renewal responsibility transfers to the client.

Use of Customer Feedback and Testimonials

Any testimonials, feedback, or communications shared with Aerosend may be used for marketing, case studies, or testimonial purposes.
However, clients may request removal or exclusion at any time, and we will honor such requests promptly.

Performance Guarantee

Aerosend offers a performance guarantee based on a direct, side-by-side comparison against your existing sending setup:

You run your Aerosend inboxes in parallel with your current setup, at the same time, using the same email copy.
Results are measured after 3 weeks of warmup followed by 5 weeks of sending.
If, over that comparison period, your Aerosend inboxes achieve a lower reply rate than your existing setup, Aerosend will refund the equivalent of two (2) months of fees for thirty (30) inboxes.

This guarantee applies only when the following conditions are met, as they are required for a fair, like-for-like deliverability comparison:

Verified recipients. All recipient email addresses must be verified before sending, including verification of catch-all addresses.
Plain-text emails. Emails must be sent as plain text, without HTML, tracking pixels, or embedded images.
Like-for-like test. Both setups must send the same email copy to a comparable lead list and audience, at a comparable volume, during the same period.

All comparisons are reviewed manually by the Aerosend team to confirm a fair, like-for-like basis. To request a review, contact support@aerosend.io with your comparison data. This guarantee is offered in addition to, and does not otherwise modify, the Refund Policy set out above.
